Litigation at the European Court of Justice

PURPOSE OF THE MICRO-CREDENTIAL
Who is this Micro-credential for?
This course is specifically designed for practising lawyers, primarily barristers, and provides an insight into the essential elements of proceedings before the European Court of Justice. It covers the rules applicable to legal representation, the way pleadings and submissions should be drafted, the applicable procedural rules, the most important instructions and practical guidelines of how to plead and argue at the oral hearings and the various litigation strategies that might be followed.
Why should I take this Micro-credential?
The training provides practical knowledge to help participants to handle both direct actions and preliminary ruling procedures before the European Court of Justice. Participants will learn how to engage effectively in proceedings, understand the the relevant procedural documents at each stage of the litigation, and explore the possibilities of oral and written pleadings.
What will I learn?
Overview of training topics:
- Introduction: the functioning and the composition of the European Court of Justice, competeneces and procedures
- Direct and indirect procedures: different phases, procedural documents, oral hearing
- The infringement procedure
- The action for annulment
- The preliminary ruling procedure
- Francovich liability, reimburesement of taxes
Course material: ppt slides, readings, commentary chapters.
How will this Micro-credential be delivered?
In addition to sharing the relevant teaching material, the course will include interactive group exercises which will on the one hand test the participants' ability to apply what they have learned to the specific procedures, and on the other hand develop their reasoning and problem-solving skills through fictitious cases. As part of the hybrid learning format, both Hungarian and international students participating online will be able to engage effectively in group work via breakout rooms. The written (home) assignments, which contribute to the assessment, develop students' analytical and legal reasoning skills. The third online assignment, a more substantial submission, will be accompanied by an online consultation due to its complexity.
How is this Micro-credential assessed?
The Micro-credential is completed by those who have completed each of the three assessed assignments and have received an overall mark of at least 65%.

COURSE DETAILS
The 15-hour course is delivered in a hybrid format, with seminars taking place on several occasions (Fridays and/or Saturdays) during the semester. Exact dates will be announced in early September.
